X-OPP SMM Terms of Service

These terms govern your use of X-OPP SMM ("the Service"). They cover what the Service does, what you are responsible for when publishing to social media through it, and the limits of what we can promise. Please read them before creating an account.

01 Agreement to these terms

By creating an account on X-OPP SMM ("the Service") at x-oppsmm.com — operated by DELEMONTECHNOLOGY FOR MARKETING AND PR, a company registered in the United Arab Emirates — you agree to these Terms of Service. If you are accepting on behalf of a company or agency, you confirm you have authority to bind that organisation, and "you" refers to it.

If you do not agree with these terms, do not use the service. Our Privacy Policy forms part of this agreement and explains how we handle your data.

02 What the Service does

The Service is a social media management tool. It lets an organisation manage multiple client brands, connect each brand's social media accounts, and publish a single piece of content to many of those accounts at once. It records the outcome of each delivery so you can see what succeeded and what failed.

The Service acts on your instruction. It does not create, review, or approve your content, and it never posts anything you have not explicitly selected and sent.

03 Your account

  • You must be at least 16 years old and able to enter a binding contract.
  • You must provide accurate registration details and keep them current.
  • You are responsible for keeping your password confidential and for everything done under your account.
  • If you invite colleagues into your organisation as admins, editors or viewers, you remain responsible for their use of the service.
  • Tell us promptly if you believe your account has been accessed without authorisation.

04 Your content

You keep all ownership of the text, images and other material you upload or publish through the Service. We claim no rights in it.

You grant us a limited, non-exclusive licence to store, process and transmit your content strictly for the purpose of operating the service — that is, so we can hold it, show it back to you, and deliver it to the social media accounts you select. This licence ends when you delete the content or close your account.

You are responsible for what you publish. You confirm you hold the rights to every piece of content you send through the Service, including images, and that publishing it does not infringe anyone's copyright, trademark, privacy or other rights.

05 Third-party social platforms

The Service connects to Facebook, Instagram, LinkedIn, X, YouTube, Reddit, Pinterest, Tumblr and TikTok. These are independent services we do not control.

  • Your use of each platform remains subject to that platform's own terms and policies, and you must comply with them.
  • Platforms may change, restrict or withdraw their APIs at any time. If that breaks a connection, we may have to disable that integration.
  • A platform may reject, remove or limit your post for its own reasons. That decision is theirs, not ours.
  • A platform may suspend your account for content you publish. We are not responsible for that outcome.

Connecting an account authorises the Service to publish to it on your behalf. You can withdraw that authorisation at any time by disconnecting the account in the Clients page, or by revoking access in the platform's own settings.

06 Acceptable use

You agree not to use the Service to:

  • Publish unlawful, defamatory, hateful, harassing, deceptive or infringing content
  • Send spam, bulk unsolicited messages, or content designed to manipulate platform engagement
  • Impersonate any person or organisation, or connect accounts you are not authorised to manage
  • Circumvent, overload or interfere with any platform's rate limits or technical protections
  • Attempt to gain unauthorised access to our systems, other organisations' data, or any account that is not yours
  • Reverse engineer, resell or redistribute the service without our written permission
  • Use the service in a way that breaches any applicable law or sanctions regime

Connecting accounts you don't manage. You may only connect social media accounts that you own or have been given explicit permission to manage on the owner's behalf. Connecting a client's account without their authorisation is a breach of these terms and, usually, of that platform's terms too.

07 Publishing and delivery

We make a genuine effort to deliver every post you send, but delivery depends on third-party APIs that we do not control. We cannot guarantee that any given post will publish successfully.

  • A post may reach some accounts and fail on others. This is recorded as a partial delivery.
  • Failures caused by expired tokens, revoked permissions, platform outages, rate limits or content rejection are outside our control.
  • Where a platform returns an error, we store and display it so you can act on it.
  • Deleting a post in the Service does not remove it from any platform it already reached. You must delete it there yourself.

Some platforms require images to be publicly reachable in order to fetch them. Images you upload are stored so they can be retrieved by those platforms during publishing.

08 Plans and fees

Every organisation using the Service is assigned a plan. Where a plan carries a fee, the price, billing period and any limits will be presented to you before you commit to it, and those purchase terms apply alongside this agreement.

We may change pricing or plan limits in future. If a change affects a plan you are already paying for, we will tell you before it takes effect so you can decide whether to continue.

09 Availability and warranties

We work to keep the Service available and reliable, but it is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the service will be uninterrupted, error-free, or that it will meet your specific requirements. We may need to take the service offline for maintenance, upgrades or security work.

10 Suspension and termination

You may stop using the Service and request deletion of your account at any time by contacting us.

We may suspend or terminate your access if you breach these terms, if your use puts the service or other users at risk, if a platform requires it, or if we are required to by law. Where it is reasonable to do so, we will warn you first and give you a chance to put things right.

On termination, your right to use the service ends immediately. We will delete your data in line with our Privacy Policy. Content already published to social platforms is unaffected and remains there until you remove it.

11 Limitation of liability

To the fullest extent permitted by law, the Service and its operators are not liable for any indirect, incidental, special or consequential loss, nor for loss of profits, revenue, goodwill, data, or business opportunity, arising out of or relating to your use of the service.

This specifically includes losses arising from a post failing to publish, publishing later than intended, reaching the wrong account, or being removed or rejected by a social media platform.

Where liability cannot lawfully be excluded, our total aggregate liability is limited to the greater of the amount you paid us for the service in the three months before the claim arose, or USD 100.

You agree to indemnify us against claims brought by third parties — including social media platforms and the owners of accounts you connect — arising from content you published or from your breach of these terms.

12 Changes to these terms

We may update these terms as the service develops. The date at the top always reflects the current version. If a change materially affects your rights, we will give you notice in the application or by email before it takes effect. Continuing to use the Service after that means you accept the revised terms.

13 Governing law

These terms are governed by the laws of the United Arab Emirates, and the courts of Dubai have exclusive jurisdiction over any dispute arising from them, without regard to conflict of law principles.

If any provision of these terms is found unenforceable, the rest remains in full effect.
